Terms of Service

Please read these Terms carefully. By accessing or using Bold Move, you agree to be bound by them.

1. Acceptance and Eligibility

By accessing getboldmove.com, placing an order, creating an account, or using any Bold Move service (collectively, the "Platform"), you ("User," "you," or "Customer") agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must not use the Platform.

You represent that you are at least 18 years of age, have the legal authority to enter into a binding agreement, and are using the Platform for lawful business or personal purposes. Use of the Platform on behalf of a company or organization constitutes acceptance of these Terms by that entity.

2. Bold Move Is a Coordination Platform — Not a Bakery

Bold Move operates as a technology-enabled coordination platform and marketplace. We connect customers who wish to send gifts with independent, locally licensed bakery businesses ("Bakery Partners") who accept and fulfill those orders.

Bold Move does not bake, prepare, handle, inspect, package, or deliver food products. All food preparation is performed exclusively by Bakery Partners, who are independent contractors and not employees, agents, representatives, or joint venturers of Bold Move.

Bold Move's role is limited to: (a) operating the Platform through which orders are placed and managed; (b) routing and assigning orders to available Bakery Partners; (c) facilitating payment; and (d) coordinating communication between the parties. By using the Platform, you acknowledge and accept this structure.

3. Independent Contractor Relationship

Bakery Partners are independent businesses that independently decide whether to accept orders, set their own operating practices, and are solely responsible for all aspects of food preparation and safety under applicable federal, state, and local food safety laws. Bold Move does not supervise, direct, or control the day-to-day operations of any Bakery Partner.

Bold Move makes no representation that any Bakery Partner is licensed, certified, inspected, or approved beyond their status as an active partner on the Platform. It is the Bakery Partner's sole responsibility to maintain all applicable food handler licenses, health department permits, and regulatory compliance.

4. Orders, Payment, and Pricing

  • All orders require full payment at checkout via Stripe, our third-party payment processor. Bold Move does not store payment card information.
  • Prices are listed in USD. International customers are responsible for any currency conversion fees charged by their bank or card issuer. Prices may change at any time for future orders. The price displayed at checkout is binding for that transaction.
  • By placing an order, you represent that all order details — including delivery address, recipient information, allergy disclosures, and design uploads — are accurate and complete. Bold Move is not responsible for failed or incorrect deliveries resulting from inaccurate information you provide.
  • Minimum lead time is 4 business days from order placement to requested delivery date. Bold Move reserves the right to reject orders that do not meet this requirement.
  • Campaign and custom orders (including "The Proposal" tiered cake) may require additional review. We will contact you within 24 hours to confirm feasibility and finalize pricing before any charge is applied.
  • Submission of an order constitutes an offer to purchase. A binding contract is formed only upon payment confirmation and Bold Move's acceptance of the order.

5. Cancellations and Refunds

Every Bold Move is a custom, perishable product made specifically for your recipient. Once a Bakery Partner confirms your order and begins preparation, that work cannot be undone. Our policy reflects that reality.

Once a bakery confirms your order — no cancellations.

After a Bakery Partner confirms your order, preparation begins. We do not accept cancellations or issue refunds for change-of-mind at this stage. If you need to cancel before bakery confirmation, email hello@getboldmove.com immediately with your order ID.

Full cash refund — when it's our fault.

You are entitled to a full refund in the following situations:

  • Delivery to wrong address due to our error. If Bold Move's routing or coordination resulted in delivery to an incorrect address that you did not provide, you will receive a full refund.
  • Not delivered on the confirmed date. If your order was not delivered on the date you selected and we confirmed, you will receive a full refund.
  • Order never arrived. We require Bakery Partners to upload a photo of the completed cake before marking delivery. If your order shows no delivery and no photo, we will investigate and issue a full refund.
  • Cake arrived damaged or completely incorrect. If the delivered cake is visibly damaged or does not match your order, contact us with photos within 24 hours of the delivery date and we will issue a full refund.
  • Bakery cancels and we cannot find a replacement. If your assigned Bakery Partner cancels and we are unable to source another bakery in your city to fulfill the order, you will receive a full refund. We will always attempt to re-route to another partner before issuing a refund.

Store credit — when it's not our fault.

In the following situations, no cash refund is issued. However, we will issue a Bold Move store credit equal to 50% of your order value, redeemable on a future order:

  • You provided an incorrect delivery address. If the address you submitted at checkout was inaccurate and delivery failed as a result, we are not responsible. We will issue store credit as a courtesy.
  • Recipient was unavailable or refused delivery. If a delivery attempt was made but the recipient was not present or refused the delivery, we did our part. We will issue store credit as a courtesy.

To submit a refund or credit request, email hello@getboldmove.com with your order ID and a brief description. Cash refunds are processed to your original payment method within 5–10 business days.

6. Delivery

  • Delivery is arranged by the Bakery Partner directly or through third-party on-demand delivery services (such as DoorDash Drive or Uber Direct). Bold Move does not employ delivery drivers and does not control the delivery process.
  • Delivery windows are estimates. Bold Move does not guarantee delivery at a specific time. Delays caused by traffic, weather, recipient unavailability, third-party delivery services, or other factors outside Bold Move's reasonable control do not entitle you to a refund.
  • Bold Move serves select cities in the United States and internationally. If your recipient's city is not currently served, you will be placed on a waitlist and no charge will be made until a Bakery Partner is confirmed in that location.
  • International deliveries (including to the United Kingdom and other countries) are subject to the Bakery Partner's local regulations, food safety laws, and delivery capabilities in that territory. Bold Move makes no warranty that international delivery will be achievable in any specific timeframe.
  • If a delivery attempt is unsuccessful due to recipient unavailability, one additional attempt may be made at Bold Move's discretion. If the second attempt fails, no refund will be issued.
  • Once a cake has been delivered and accepted, Bold Move has no further delivery obligations.

7. Food Safety, Allergens, and Consumer Responsibility

IMPORTANT — PLEASE READ CAREFULLY.

  • Bold Move does not prepare, handle, inspect, or have physical possession of any food product at any time. All food is prepared by independent Bakery Partners in their own licensed facilities.
  • You are solely responsible for disclosing all known food allergies, dietary restrictions, and medical dietary needs for the intended recipient at the time of checkout. Bold Move will communicate this information to the assigned Bakery Partner.
  • Allergen notice — all orders: Bakery Partners operate commercial kitchens that routinely handle major allergens. Bold Move cannot guarantee that any product is free from allergens or cross-contamination.
  • UK allergen notice (Food Information Regulations 2014): The 14 major allergens regulated under UK law are: celery, cereals containing gluten (wheat, rye, barley, oats), crustaceans, eggs, fish, lupin, milk, molluscs, mustard, tree nuts (almonds, hazelnuts, walnuts, cashews, pecans, brazil nuts, pistachios, macadamia nuts), peanuts, sesame, soybeans, and sulphur dioxide/sulphites. Bakery Partners handling UK orders are required to provide allergen information in accordance with the Food Information Regulations 2014. Customers placing orders for UK delivery are strongly advised to contact the Bakery Partner directly via Bold Move to confirm allergen status before consumption.
  • The preparation of all food in accordance with disclosed allergy information is the sole and exclusive responsibility of the Bakery Partner. The Bakery Partner operates as a licensed food business subject to applicable health and safety regulations independent of Bold Move.
  • Bold Move expressly disclaims all liability for allergic reactions, foodborne illness, or any other health consequences arising from consumption of products fulfilled through the Platform, whether or not allergy information was disclosed, and whether or not the Bakery Partner failed to follow that information. Consumption of any food product is at the recipient's sole risk.
  • If you have any concern about a recipient's serious food allergy, you are strongly advised to contact us before ordering so we can confirm the specific Bakery Partner's capabilities. Even then, Bold Move makes no guarantee.

8. UK and EU Consumer Rights

Nothing in these Terms affects any statutory rights you have under applicable law that cannot be excluded or limited by contract. If you are a consumer located in the United Kingdom or European Union, the following applies:

  • UK Consumer Rights Act 2015: You are entitled to services performed with reasonable care and skill. If we fail to meet this standard, you may be entitled to a repeat performance or a price reduction. For goods (the cake itself), your statutory rights against the Bakery Partner are preserved and are not affected by these Terms.
  • EU Consumer Rights Directive: EU consumers have statutory rights that vary by member state. These Terms do not limit those rights.
  • Right to cancel (digital services): By requesting that Bold Move begin fulfilling your order immediately upon payment, you acknowledge that the 14-day cooling-off period under the UK Consumer Contracts Regulations 2013 and EU Consumer Rights Directive does not apply once the Bakery Partner has confirmed and begun preparation of your custom perishable order.
  • Complaints: UK consumers may seek redress through the Citizens Advice consumer helpline or Trading Standards. EU consumers may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

9. No Guarantee of Business Results

Any statistics, case studies, or outcome projections referenced on the Platform (including meeting rate estimates) are for illustrative purposes only and do not constitute a guarantee of any specific business result. Bold Move makes no warranty that sending a cake will result in a meeting, a sale, a reply, or any other commercial outcome. Results vary and depend entirely on factors outside Bold Move's control.

9. Custom Designs and Uploaded Content

  • By uploading any image, design, logo, QR code, or other content ("User Content"), you represent and warrant that you own or have all necessary rights, licenses, and permissions to use and reproduce that content for the purpose of cake decoration, and that such use does not infringe any third-party intellectual property, privacy, or other rights.
  • You grant Bold Move a limited, non-exclusive license to use your User Content solely to fulfill your order and for no other purpose.
  • Bold Move reserves the right to reject any order or User Content that is unlawful, obscene, defamatory, or that Bold Move determines in its sole discretion it cannot fulfill.
  • You are solely responsible for any legal consequences arising from the content you upload. Bold Move is not liable for any claims arising from User Content provided by you.

10. Bakery Partner Terms

By registering as a Bakery Partner, you agree to:

  • Maintain all required food handler licenses, health permits, and regulatory compliance independently and at your own cost
  • Fulfill assigned orders in a timely, professional manner consistent with Bold Move's quality standards and the specifications provided
  • Confirm or decline orders within 4 business hours of assignment. Failure to confirm within this window grants Bold Move the right to reassign the order without notice
  • Take sole responsibility for food safety, allergen management, and compliance with all applicable food preparation laws
  • Use customer information only for the purpose of fulfilling the assigned order and maintain its confidentiality
  • Accept that Bold Move may remove you from the network for quality failures, compliance issues, or repeated failure to meet confirmation windows, at Bold Move's sole discretion
  • Indemnify Bold Move for any claims arising from your food preparation, delivery, or other actions taken in fulfilling an order

11. Accounts and Security

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You must notify us immediately at hello@getboldmove.com if you suspect unauthorized access.
  • Bold Move reserves the right to suspend or terminate any account at its sole discretion for violations of these Terms, fraudulent activity, or conduct harmful to the Platform or its users.

12. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOLD MOVE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; ANY WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; ANY WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, OR COMPLETENESS OF ANY CONTENT; AND ANY WARRANTY WITH RESPECT TO THE FOOD PRODUCTS PREPARED BY INDEPENDENT BAKERY PARTNERS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOLD MOVE, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS OPPORTUNITY, LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, BODILY HARM, ALLERGIC REACTIONS, FOODBORNE ILLNESS, OR ANY OTHER HARM ARISING FROM CONSUMPTION OF FOOD PRODUCTS, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF BOLD MOVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, BOLD MOVE'S MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE PLATFORM IS LIMITED TO THE AMOUNT YOU ACTUALLY PAID BOLD MOVE FOR THE SPECIFIC ORDER GIVING RISE TO THAT CLAIM. THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF THE CLAIM AND REGARDLESS OF WHETHER BOLD MOVE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.

14. Indemnification

You agree to defend, indemnify, and hold harmless Bold Move and its officers, directors, employees, agents, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) any User Content you submit; (d) your violation of any third-party rights; (e) any inaccurate information you provide, including failure to disclose allergies; or (f) any dispute between you and a Bakery Partner.

15. Force Majeure

Bold Move is not liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemic, strikes, supply chain disruptions, government orders, power outages, internet or telecommunications failures, or acts of third parties including Bakery Partners and delivery services.

16. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of the State of South Dakota, without regard to conflict of law principles.

UK users: Notwithstanding the above, if you are a consumer habitually resident in the United Kingdom, you may bring legal proceedings in the courts of England and Wales, Scotland, or Northern Ireland (as applicable), and you retain the benefit of any mandatory provisions of UK consumer law that cannot be contractually excluded.

EU users: If you are a consumer habitually resident in an EU member state, you may bring proceedings in the courts of your country of residence, and you retain the benefit of mandatory provisions of the law of your country of residence.

Before initiating any formal dispute, you agree to first contact Bold Move at hello@getboldmove.com and attempt in good faith to resolve the matter informally. Most concerns are resolved this way within 5 business days.

For US users, if informal resolution fails, any claim or dispute shall be resolved by binding individual arbitration under the rules of the American Arbitration Association ("AAA"), rather than in court. The arbitration shall be conducted in English on a documents-only or telephonic basis unless both parties agree otherwise.

CLASS ACTION WAIVER (US users): YOU AND BOLD MOVE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

17. Changes to Terms

Bold Move may update these Terms at any time. We will notify registered users of material changes by email and will update the "Last updated" date at the top. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.

18. General Provisions

  • Severability: If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and all other provisions remain in full effect.
  • Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Bold Move and supersede all prior agreements or understandings regarding the Platform.
  • No Waiver: Bold Move's failure to enforce any provision does not constitute a waiver of its right to enforce it later.
  • Assignment: You may not assign your rights or obligations under these Terms without Bold Move's written consent. Bold Move may assign its rights without restriction.
